No Material to Show Al Qaeda Links, Jharkhand HC Grants Bail to Maulana

Maulana Mohhamad Kalimuddin Mujahiri who was arrested in September 2019 for his alleged involvement with terror outfit Al-Qaeda was on Wednesday granted bail by Jharkhand High Court.

The Bench of Justice Kailash Prasad Deo, in its order, observed, “No material has been collected with regard to the involvement of the petitioner in any activities of Al-Qaeda outfit nor the Investigating Officer has collected any material with regard to the money given to this petitioner by any Organization, who was involved in unlawful activities.”

While granting him bail, the Court said, “Considering the fact that the petitioner is a Maulana having no criminal antecedent, this Court is inclined to enlarge the petitioner on bail.”

Mujhahiri was in jail for one year under the stringent anti-terror law Unlawful Activities (Prevention) Act (UAPA). He was accused of meeting two alleged co-conspirators Ahmed Masood Akram Sk and Abdul Rahman Katki at his house in Sakchi Madarsa and subsequently receiving money from Gujarat for carrying out ‘anti-national work as a jihadi’.

ML Meena, the then Additional Director General of Police, in 2019, had said, “Kalimuddin is the most wanted terrorist of Al Qaeda. He has been arrested from Tatanagar railway station. He was preparing and motivating the youths for jihad in the Indian sub-continent.”

The Counsel for the petitioner had submitted that the petitioner is a Maulana and no material was collected during the investigation so as to prove guilt against the petitioner with regard to his involvement in anti-national activities.
